1. Scope

1.1 These Terms and Conditions apply to all contracts between IKH Didactic Systems / KAFTAN-media and customers concluded via the online shop.
1.2 Customers may be consumers or business customers. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.3 Conflicting or deviating terms of the customer shall only apply if IKH Didactic Systems / KAFTAN-media has expressly agreed in writing.
1.4 These T&Cs also apply to future business relationships without the need for a separate reference.

2. Offer and Conclusion of Contract

2.1 Product presentations in the online shop are not a legally binding offer but an invitation to order.
2.2 By clicking the "Buy now" button (corresponds to “Complete purchase” button), the customer submits a binding offer to purchase the items in the shopping cart.
2.3 The customer receives an order confirmation by email. This confirmation does not yet constitute acceptance of the contract.
2.4 The contract is concluded either by an explicit order confirmation or by dispatch of the goods.
2.5 The subject of the contract is exclusively the goods ordered as described.
2.6 The contract text is stored by IKH Didactic Systems / KAFTAN-media. Past orders can be viewed in the customer account.

3. Prices and Payment Terms

3.1 All prices in the online shop include statutory VAT.
3.2 The customer bears the shipping costs. Shipping costs are displayed during the ordering process.
3.3 For international deliveries, shipping costs will be communicated individually during the ordering process or after ordering.
3.4 For prepayment, the order will only be processed and shipped after receipt of payment.
3.5 Business customers may purchase on account by prior agreement.
3.6 Additional payment methods may be specified in the online shop.

4. Right of Withdrawal for Consumers

The right of withdrawal as provided in the shop applies. The withdrawal information is made available to the customer prior to placing the order and can be accessed at any time in the online shop.

5. Delivery

5.1 Delivery times are indicated in the shop or in the order confirmation.
5.2 Partial deliveries are permitted if reasonable for the customer.
5.3 Delivery time begins after receipt of payment if prepayment has been agreed.

6. Transfer of Risk

6.1 For consumers, the risk of accidental loss or deterioration of the goods passes upon handover to the customer.
6.2 For business customers, the risk passes upon handover to the transport service provider.

7. Retention of Title

The goods remain the property of IKH Didactic Systems / KAFTAN-media until full payment has been received.

8. Liability

8.1 IKH Didactic Systems / KAFTAN-media is fully liable for damages resulting from injury to life, body, or health, as well as for damages caused intentionally.
8.2 In cases of gross negligence, IKH Didactic Systems / KAFTAN-media is only liable for the breach of essential contractual obligations (cardinal obligations). Liability is limited to the foreseeable, contract-typical damage at the time of contract conclusion.
8.3 In cases of ordinary negligence, IKH Didactic Systems / KAFTAN-media is only liable for breach of essential contractual obligations and only for foreseeable, contract-typical damage.
8.4 Any further liability is excluded, in particular for indirect or consequential damages and loss of profit.
8.5 The above liability limitations also apply to the statutory representatives, employees, and agents of IKH Didactic Systems / KAFTAN-media.

9. Warranty

For consumers, the statutory warranty period of 24 months applies.
For business customers, the warranty period is 12 months.
Statutory inspection and notification obligations (§ 377 HGB) remain unaffected.

10. Copyright

All content, images, texts, and data on the website are protected by copyright. Any use without consent is prohibited.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. IKH Didactic Systems / KAFTAN-media is neither obliged nor willing to participate in dispute resolution proceedings before consumer arbitration boards.

12. Final Provisions

12.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
12.2 If the customer is a business, the place of jurisdiction is the registered office of IKH Didactic Systems / KAFTAN-media.
12.3 Should individual provisions be invalid, the remainder of the contract remains effective.
12.4 Amendments and additions require written form.
